Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the services (the "Service") provided by blueover (the "Company") on this website. Registered users (each, a "User") shall use the Service in accordance with these Terms.

Article 1 (Application)
These Terms shall apply to all relationships between Users and the Company relating to the use of the Service.

Article 2 (Registration)
Registration is completed when an applicant applies for registration by the method prescribed by the Company and the Company approves the application.
The Company may decline to approve a registration application if it determines that the applicant falls under any of the following, and the Company shall bear no obligation to disclose the reason:
(1) The applicant has provided false information in the registration application
(2) The applicant has previously violated these Terms
(3) The Company otherwise determines that the registration is not appropriate

Article 3 (Management of User ID and Password)
Users shall manage their Service user ID and password at their own responsibility.
Users may not, under any circumstances, transfer or lend their user ID or password to a third party. The Company will treat any login using a user ID and password combination that matches the registered information as use by the User who registered that ID.

Article 4 (Product Price and Payment Method)
In consideration for using the Service, the User shall pay the product price separately determined by the Company and displayed on this website, by the method designated by the Company.

Article 5 (Prohibited Actions)
Users shall not engage in the following acts when using the Service:
(1) Acts that violate laws, regulations, or public order and morals
(2) Acts related to criminal activity
(3) Acts that destroy or interfere with the functions of the Company's servers or network
(4) Acts that may interfere with the Company's operation of the Service
(5) Acts of collecting or accumulating personal information about other Users
(6) Acts of impersonating another User
(7) Acts of providing, directly or indirectly, benefits to anti-social forces in connection with the Company's services
(8) Any other act that the Company deems inappropriate

Article 6 (Suspension of the Service)
The Company may suspend or discontinue all or part of the Service without prior notice to Users if it determines that any of the following applies:
(1) When performing maintenance, inspection, or updates to the computer systems related to the Service
(2) When it becomes difficult to provide the Service due to force majeure such as earthquake, lightning, fire, power outage, or other natural disaster
(3) When a computer or communication line is stopped due to an accident
(4) When the Company otherwise determines that providing the Service is difficult
The Company shall bear no responsibility whatsoever for any disadvantage or damage suffered by a User or a third party as a result of the suspension or discontinuation of the Service.

Article 7 (Restriction of Use and Deregistration)
The Company may, without prior notice, restrict a User's use of all or part of the Service, or cancel a User's registration, in any of the following cases:
(1) When the User violates any provision of these Terms
(2) When it is discovered that the registered information contains false information
(3) When the Company otherwise determines that use of the Service is inappropriate
The Company shall bear no responsibility for any damage caused to a User as a result of actions taken by the Company under this Article.

Article 8 (Disclaimer)
The Company shall be exempt from liability for breach of contract unless such breach is due to the Company's willful misconduct or gross negligence.
Even where the Company is liable for any reason, its liability for damages shall be limited to the ordinary scope of damages, and, in the case of a paid service, to the amount of the price paid (or, for continuous services, an amount equivalent to one month's fee).
The Company shall bear no responsibility for any transactions, communications, or disputes that arise between a User and another User or a third party in connection with the Service.

Article 9 (Changes to the Service)
The Company may change the content of the Service or discontinue the Service without notifying Users, and shall bear no responsibility for any damage caused to Users as a result.

Article 10 (Changes to the Terms)
The Company may revise these Terms at any time without notifying Users, whenever it determines that this is necessary.

Article 11 (Notices and Communications)
Notices or communications between a User and the Company shall be made by the method prescribed by the Company.

Article 12 (Prohibition on Assignment of Rights and Obligations)
Users may not transfer or pledge as collateral their position under the usage agreement, or any rights or obligations under these Terms, to a third party without the Company's prior written consent.
Article 13 (Governing Law and Jurisdiction)

These Terms shall be governed by and interpreted in accordance with the laws of Japan.
In the event of a dispute concerning the Service, the court having jurisdiction over the location of the Company's head office shall have exclusive agreed jurisdiction.
